By using or accessing this website or by using any of the content hosting and sharing services provided via the Site, you agree to be bound by these Terms of Service. If you do not agree to the terms of this Agreement, then you may not use or access the Site or any of the Services.

Version 2 Limited may, in its sole discretion, modify this Agreement from time to time, and may modify, suspend, or terminate the Site and Services, for any reason, and without notice. Although you may be asked to indicate your assent to the terms of this Agreement only once, the terms of this Agreement, as modified by Version 2 Limited from time to time, will govern all use of the Site and Services.

Description of the Services

Version 2 Limited provides its Registered Users (defined below) with the ability to host a variety of content, including without limitation images that Registered Users own or to which they have the necessary rights to share User Content via the Web.

Although the Site and Services are normally available, there will be occasions when the Site or Services will be interrupted for scheduled maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and equipment that are beyond the control of Version 2 Limited. Also, although Version 2 Limited will normally only delete Content that violates this Agreement, Version 2 Limited reserves the right to delete any Content for any reason without prior notice. Deleted content may be stored by Version 2 Limited in order to comply with certain legal obligations and is not retrievable without a valid court order. Version 2 Limited will not be liable to you for any modification, suspension, or discontinuation of the Services, or the loss of any Content.

General use of the Website -- Permissions and Restrictions:

1. You agree not to distribute in any medium any part of the Website.
2. You agree not to alter or modify any part of the Website.
3. You agree not to use the Website for any commercial use, such as for the primary purpose of gaining advertising or subscription revenue. Prohibited commercial uses do not include uploading to promote your business or artistic enterprise.
4. Version 2 Limited grants the operators of public search engines permission to use spiders to copy materials from the site for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials. Version 2 Limited reserves the right to revoke these exceptions either generally or in specific cases. You agree not to collect or harvest any personally identifiable information, including account names, from the Website, nor to use the communication systems provided by the Website (e.g. comments, email) for any commercial solicitation purposes. You agree not to solicit, for commercial purposes, any users of the Website with respect to their User Submissions.
5. You will otherwise comply with the terms and conditions of these Terms of Service and all applicable local, national, and international laws and regulations.
6. Version 2 Limited reserves the right to discontinue any aspect of the Website at any time.

Accounts and Passwords

In order to access certain features of the Site and the Services, and to post Content, you must create an account. You may create an account on the Registration Page. Once you have created an account, you will be a "Registered User". Registered Users are limited to one free account per person.

Your account is solely for your own personal use and benefit. You are responsible for safeguarding the password that you use to access the Site and Services. You agree not to disclose your password to any third party nor to permit any third party to use your account. You agree to take sole responsibility for any activities or actions under your password, whether or not you have authorized such activities or actions. You will immediately notify Version 2 Limited of any unauthorized use of your password. In registering and creating an account, you agree to provide accurate, current and complete information, and to promptly update that information as necessary. Version 2 Limited will have no liability for failure to deliver notices that result from inaccurate account information.

You are limited to the file size, bandwidth, and storage limitations. Version 2 Limited reserves the right to disable direct linking on accounts that are using excessive bandwidth or otherwise abusing the system. Version 2 Limited has the right to change its file size, bandwidth, or storage limitations without notice.

Version 2 Limited reserves the right at all times to terminate your account, and delete any and all Content, in whole or in part, for any reason including without limitation a breach of any part of this Agreement.

License

Version 2 Limited does not claim any ownership rights in any User Content that you choose to post to the Site. After posting User Content to the Site,you continue to retain all ownership or license rights in your User Content and you continue to have the right to use your User Content as you did prior to such posting. However, by posting or making User Content available through the Site or via the Services, you hereby grant to Version 2 Limited a nonexclusive, royalty-free, transferable, worldwide license to use, copy, modify, prepare derivative works from, distribute, publicly display and publicly perform and process your User Content, or any part of it, solely on and through the Site and Services.In addition, where you have made your User Content public, posted a link to your User Content on another website or otherwise shared a link to your User Content, you grant to Version 2 Limited a nonexclusive, royalty-free, worldwide right to sublicense the right to copy, modify, prepare derivative works from, and distribute your User Content as necessary to perform the Services, including without limitation the printing services offered by Partner Sites.

Copyright Infringement Notification

To file a copyright infringement notification with us, you will need to provide your information. Please note that under Section 512(f) of the Copyright Act any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

Your User Submissions and Conduct

You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. In connection with User Submissions, you affirm, represent, and/or warrant that: you own or have the necessary licenses, rights, consents, and permissions to use and authorize Version 2 Limited to use the copyright or other proprietary rights in and to any and all User Submissions to enable inclusion and use of the User Submissions in the manner contemplated by the Website and these Terms of Service. Version 2 Limited may delete the submissions after the promotion.

Restrictions

You will not do any of the following while using or accessing the Site or the Services:

1. Post, upload, email or otherwise transmit any Content that you do not have the lawful right to copy, transmit and display, any Content for which you do not have the consent or permission of each identifiable person in the Content to use the name, voice, signature, photograph, or likeness of each such person and any Content that infringes the intellectual property rights or violates the privacy rights of any third party.
2. Delete, or in any manner alter, the copyright, trademark, or other proprietary rights notices appearing on any Content except your User Content.
3. Use any meta tags or other hidden text or metadata utilizing a Version 2 Limited's name, trademark, URL or product name without Version 2 Limited's express written consent.
4. Post, upload, email or otherwise transmit, without first obtaining the permission of Version 2 Limited, any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, "pyramid schemes", Ponzi schemes or any other form of solicitation.
5. Post, upload, email, or otherwise transmit, via the Site or Services, any Content that is unlawful, obscene, harmful, threatening, harassing, defamatory, or hateful, or that contains objects or symbols of hate, invades the privacy of any third party, contains nudity or pornography is deceptive, threatening, abusive, inciting to unlawful action, defamatory, libelous, vulgar or violent, or constitutes hate speech, or is otherwise objectionable in the opinion of Version 2 Limited.
6. Post, upload, email, or otherwise transmit any Content that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software and interfere with the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Site.
7. Post, upload, email or otherwise transmit any Content that includes code that is hidden or otherwise surreptitiously contained within the images, audio or video of any Content that is unrelated to the immediate, aesthetic nature of the Content.
8. Attempt to probe, scan or test the vulnerability of any system or network or breach any security or authentication measures.
9. Collect or store personal data about other users without their express permission.
10. Resell the Services, in whole or in part.
11. Violate any applicable law, regulation, or ordinance.
12. Use the Site or Services in any manner not permitted by this Agreement.

The Site may contain links to third-party websites or resources. You acknowledge and agree that Version 2 Limited is not responsible or liable for the availability or accuracy of such websites or resources and the content, products or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by Version 2 Limited of such websites or resources or the content, products, or services available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources. For the terms and conditions governing your use of Partner Sites, refer to the terms of service governing those websites.

Privacy Notice

Personal Information

1. Non-Account Activity. You can view the websites without having an Account.
2. Account-Related Activity. Certain other activities on like uploading files require you to have a Account. We ask for some personal information when you create an Account, including your email address and a password, which is used to protect your account from unauthorized access.
